Don’t Rejoice Just Yet: An Imminent Threat to Supreme Court’s Overturning of Roe v. Wade
The Dobbs v. Jackson Women’s Health Organization abortion decision will have a global impact. The call to defend life was the reason I went to law school.
Having seen the evil face of abortion and the destruction of helpless children, I celebrate that Roe v. Wade and Planned Parenthood v. Casey are gone. And I give thanks to God.
But now, following the Dobbs decision, the battle for life has intensified in Congress, the state legislatures and the state courts.
If any two of four pro-abortion senators change their vote on the filibuster, the 60-vote rule will be abolished, and the abortion bill in the Senate will force abortion on all the states. We cannot rest. We could easily lose this great victory for life.
An abortion bill has already passed the House of Representatives and just needs to get through the Senate. Earlier this year, Democrat Senators Joe Manchin of West Virginia and Kyrsten Sinema of Arizona said they oppose abolishing the 60-vote filibuster rule. So did Republican Senators Susan Collins of Maine and Lisa Murkowski of Alaska. And all four want to codify Roe v. Wade as a federal law.
If only two of these four senators cave in and support the “nuclear option” to erase the filibuster, they can pass the abortion bill. But it will not stop there.
On Friday, violence erupted around the Arizona capitol building with legislators trapped inside. The violent protesters had to be dispersed with tear gas. Sen. Sinema is from Arizona. The pressure on members of Congress is intense.
California Rep. Maxine Waters (D) exclaimed, “The hell with the Supreme Court.”
New York Sen. Chuck Schumer (D) also bemoaned Friday, “Today is one of the darkest days our country has ever seen.” Standing in front of the Court in March 2020, Schumer threatened Justices Gorsuch and Kavanaugh, saying: “I want to tell you, Gorsuch, I want to tell you, Kavanaugh, you have released the whirlwind and you will pay the price! You won’t know what hit you if you go forward with these awful decisions!”
Meanwhile, Joe Biden has called on Congress to “restore the protections of Roe v. Wade as federal law.”
I want to emphasize again, if only two more senators vote to abolish the 60-vote filibuster rule, the Dobbs decision will be erased and abortion will again be forced on the states.
Liberty Counsel has defended life since our founding in 1989. After Dobbs, the battle intensified. We will continue fighting in Congress, in the state legislatures and in the state courts.
In addition to our ongoing legislative work at state and federal levels, we will increasingly be defending life in court at the state level, including in state Supreme Courts. That is where the battle will primarily focus now that Roe and Casey have been overturned.
If the filibuster is abolished, and abortion and other bad bills become law, the elections this fall will not undo these terrible bills. Even if there is a change in leadership in the House and Senate this fall, and Congress votes to repeal these bills, Joe Biden will veto their vote. These terrible bills will remain law for more than two years—at a minimum!
Sen. Murkowski told CBS the Dobbs abortion decision “creates a growing need for the Senate to pass the ‘Women’s Health Protection Act,'” which is the abortion bill. In addition, Sen. Collins stated she supported Kavanaugh’s nomination to the Court because she “believed he would uphold Roe v. Wade.”
The Dobbs decision said that “Roe was egregiously wrong from the start.” Indeed, abortion has no basis in the Constitution.
We have worked decades for this magnificent victory for life. This decision will reverberate around the world. Law students will be taught about Dobbs and not about the constitutionally baseless Roe and Casey opinions. And best of all, many children will now live who may have died a cruel death!
Along with our pro-life work, including defending Sandra Merritt, who revealed the Planned Parenthood doctors’ harvesting of baby body parts, we continue working in our class action case on behalf of service members in all U.S. military branches regarding the illegal COVID shot mandates. This week and in July, there will be a flurry of legal activity. I will update you soon.
